Terms of Service

By accessing or using the Whitehirst service ("Service"), you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Service Description

Whitehirst provides high-performance cloud workstations hosted in the European Union (Germany). These are virtualized instances running on dedicated hardware resources.

You acknowledge that you are renting computing power and storage. You are the sole administrator of the Operating System provided.

2. Data Sovereignty

Your primary data is hosted physically in Nuremberg, Germany.

Whitehirst Ltd. is a registered entity in the United Kingdom. We guarantee that your workstation data remains within the UK/EU legal jurisdiction. We do not replicate your data to US-based data centers.

5. Payments & VAT

Services are billed via Stripe. Prices displayed on the website are exclusive of VAT unless stated otherwise.

UK Customers: VAT at the standard UK rate (20%) will be added at checkout.

EU Business Customers: VAT may be reverse-charged if a valid VAT ID is provided.

6. Licensing (SPLA & BYOL)

Whitehirst operates under the Microsoft Service Provider License Agreement (SPLA). The Windows Server operating system is licensed to you as a service.

If you choose to install your own software or modify the OS to run Windows 10/11 Enterprise (BYOL), you warrant that you possess the necessary valid licenses.

7. Limitation of Liability

In no event shall Whitehirst Ltd. be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales.
